The Eagles have notified the defendant of a supplemental addition to it's proposed lawsuit, the following is included as apart of that amendment.

In a Texas unfair competition claim, a plaintiff must establish one of the above underlying torts or other illegal conduct that caused actual harm to the plaintiff's business.

The elements of unfair competition or common law misappropriation have been defined as (1) the

creation of plaintiff's product (i.e., the trade secret information) through extensive time, labor, skill, and

money; (2) the defendant's use of that product in competition with the plaintiff, thereby gaining a

special advantage in that competition (i.e., a "free ride") because defendant is burdened with little or

none of the expense incurred by the plaintiff; and (3) commercial damage to the plaintiff. United States

Sporting Prods., Inc. v. Johnny Stewart Game Calls, Inc., 865 S.W.2d 214, 218 (Tex. App.-Waco 1993,

writ denied).

It is well established that the Defendant has gotten a free ride.

The Eagles operate as a non-profit organization, as does the TIBL 21U and all youth programs related to the league and academies.

The Cleburne Eagles return from a rich history operating from the 1920's up through the late 1960's using Carver Park as its home field at the time, today that location will once again serve as a location for free clinics and other community related team functions.
